And on the other hand, the User - Client (hereinafter the User), registered on the website by means of a username and password, for which they have full responsibility for use and custody, being responsible for the truthfulness of the personal data provided to the provider.
BOTH ACCEPT this document, and it implies that the user:
a. You have read, understood, and comprehend the foregoing.
b. Who is an adult of age and with sufficient capacity to contract.
c. That it assumes all obligations set forth herein.
d. That they have read and accept these general purchase conditions from the moment they acquire any product offered.
This document may be printed and stored by Users.

2.1 Scope of Application: The purpose of this contract is to regulate the contractual purchase and sale relationship that arises between the provider and the user at the moment the user accepts these purchase conditions during the online contracting process by checking the corresponding box. The contractual relationship of sale involves the delivery of a specific product in exchange for a price determined and publicly displayed on the website.

3.1 Price Publication: Exceptionally, the prices of products displayed on our website may be erroneously specified and show a price lower than the correct one. When this happens, and if we have confirmed your order, we will contact you immediately in order to issue a new order confirmation with the correct price. In the event that the corresponding price is higher, you may cancel your order and we will refund any amount you have already paid.
3.2 Product Information: The information contained in our advertisements, brochures, other written materials, on our website, or provided by our agents or employees constitutes an invitation to do business. Such information does not constitute an offer to supply any product on our part.
The content on vamzshop.com is constantly being renewed and updated to offer our customers the most complete and detailed information possible. Because of this, it is possible that the content may, in exceptional cases, display provisional information about some products. If the information provided does not correspond to the characteristics of the product, the customer will have the right to cancel their purchase at no cost to them.
All contractual information present on the website is displayed in Spanish (Castilian), and communication with clients and users, as well as the formalization of the contract, will be carried out in this language. However, if the client so desires, it can be done in another language, provided it is indicated before commencing the contracting procedure.
3.3 Product Availability: There may be occasions when it is impossible to supply all products because they are out of stock or unavailable at the time of purchase. In such cases, we will contact you to offer you the following options:
a) selection of an alternative product with similar characteristics to the product to be replaced;
b) communicating its availability, in case you prefer to wait for said product to be back in stock at the store.
If our suggestions are declined, the order related to these products will be canceled, and any sums you have paid for them will be refunded.
3.4 Right of Annulment: VITA MAZHAROVA reserves this action (right of annulment) for the shipment of a specific product that does not meet the quality requirements imposed on all vamzshop.com products. In the event such a quality defect is detected, VITA MAZHAROVA's Customer Service will suggest a replacement product, and if the replacement is not to the customer's satisfaction, the cost of said product will be refunded.
3.5 Orders 24/7, all year round: The order reception hours are twenty-four (24) hours a day, three hundred sixty-five (365) days a year. However, orders placed after seven (19:00) hours will not be processed and will be handled on the next business day at Calle Ramón y Cajal, 29 Santa María de Palautordera C.P.08460 (Barcelona). Orders received on the weekend will be processed first thing the following Monday, or the next business day.
3.6 Fraud: If VITA MAZHAROVA suspects or detects any anomaly or fraud, they reserve the right to cancel the transaction for security reasons.

The delivery time is usually between 1-7 business days, depending on the destination and payment method chosen. This term is understood as long as the availability of the merchandise has been confirmed and full payment of the order has been verified.
The Provider will not assume any responsibility when the delivery of the product or service does not take place due to false, inaccurate, or incomplete data provided by the user.
Delivery will be considered complete when the carrier has made the products available to the user and the user, or their delegate, has signed the delivery receipt document.
It is the User's responsibility to verify the products upon receipt and to state any reservations and claims that may be justified in the delivery receipt document.
In cases where the hiring does not involve the physical delivery of any product, with these being directly downloaded from the website, the provider will inform the user in advance about the procedure they must follow to carry out this download.

- PRICES AND OFFER VALIDITY PERIODS
All prices shown on the store vamzshop.com include the VAT in effect at the time of purchase. All prices listed on the website are valid except for typographical errors or while supplies last and will in any case be expressed in Euros (€). Said expenses, unless expressly stated otherwise, do not include shipping costs, handling, packaging, shipping insurance, or any other additional services related to the purchased product or service. Payment made to the provider will result in the issuance of an invoice in the name of the registered user. Said invoice will be automatically sent to the email address provided by the user, as well as included with the purchased product.
The prices applicable to each product will be those published on the website and automatically applied by the contracting process in its final phase. The client assumes that, in any case, the economic valuation of some of the products may vary in real-time. In any case, this will always be communicated to users in advance.
In cases of limited-time promotions, the promotional discount will be applied as long as the order was registered during the promotion period.
The data recorded by the different payment methods constitute proof of the date on which the financial transactions were made and will be used to determine whether said order is subject to a promotion.

7.1 Payment by credit or debit card: The user must have a valid credit or debit card, on which all digits of the card number must be specified in the corresponding form. The transaction is finalized at the time of placing the order. By clicking the “Return to website” button, you will be taken back to the website to view and print your order. PayPal has its own privacy policies and VITA MAZHAROVA it has no responsibility whatsoever for them.

8.1 Shipping Address: The delivery of orders will be made to the delivery address freely designated by the user. Therefore, the provider assumes no responsibility whatsoever when the product delivery cannot be completed due to the data provided by the user being false, inaccurate, or incomplete, or when delivery cannot be made due to reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the recipient.
The order delivery schedule will be during regular business hours.
Notwithstanding the foregoing, the provider has taken the measures required of a diligent merchant to ensure that delivery can be made within the agreed time, and therefore no liability may be attributed to the provider.
VITA MAZHAROVA will make every effort to ensure your order is delivered within the timeframe listed on our website at the date of order confirmation.
8.2 Delivery Times: correspond to those set out in each product's description. In the case of products not available at the time of purchase, our Customer Service can provide you with availability information and a delivery timeframe.
If you have ordered multiple products in the same order, please note that they may have different availability dates, in which case you may receive them on different dates. Please note that if any of the items are unavailable at the time of shipment, you have the right to cancel the order at any time before shipment by contacting our Customer Service at the following email address: info@vamzshop.com, stating the order number.
8.3 Shipping Confirmation: When your order is handed over to our carrier, we will send you a shipping confirmation to the email address you provided when placing your order. In the shipping confirmation, we will provide you with the corresponding tracking number so you can track your shipment on our carrier's website.
8.4 Shipping Damage: Products are delivered in secure packaging. If, at the time of delivery and clearly visible without needing to unpack the shipping or product packaging, it's apparent that a product has defects caused by transport damage, or if there is a clear error in the merchandise received, the customer must detail this fact on the receipt signed to the carrier and immediately contact our Customer Service line at 623994011 or via email at devolucion@vamzshop.com within 24-48 hours of receipt. This will allow us to process the return of the affected product(s) and proceed with their replacement with optimal condition items or, alternatively, to refund the price paid for them, as indicated in your email.
A delivery receipt without any damage notation is equivalent to a product in perfect packaging condition. Likewise, if product damage is detected after opening the package while the packaging is in perfect condition, the customer has 24 hours from receipt to contact our Customer Service line at 623994011 or email devolucion@vamzshop.com. Claims for product damage will not be accepted after 24-48 hours from delivery.

- RIGHT OF WITHDRAWAL
9.1 Right of Withdrawal: The User has 14 calendar days, counted from the product delivery date, to return the product (art. 71 Law 3/2014, of March 27). If you are not satisfied with the product or any of the products in your order, you may exercise your right of withdrawal by filling out the form attached to these conditions, with your order number (to obtain a refund for the amount of the product(s) within a maximum period of fourteen (14) calendar days following receipt of the order) along with your contact details. The product must be returned in its original packaging and in perfect condition.
We will provide you with a return number and instructions for the return procedure. You must send it to us by email at info@vamzshop.com or by postal mail, always within 14 calendar days of receiving the order. After this period, you may only request the return or exchange of the product(s) for technical reasons subject to the warranty of said product(s).
You must return the product with all the items with which it was delivered, without damage or signs of wear of any kind, and which do not denote improper use of the good or use contrary to its own nature, to the address we have provided.
It is recommended to return the item in its original packaging. If this is not possible, the product will be depreciated in value. The customer will be responsible for the packaging and protection of the product(s) they send, as well as the shipping costs.
As long as the products are returned within 14 calendar days, without any damage or signs of wear, and comply with the requirements established in this section, with the return number we will have provided you, we will refund the total purchase amount.

9.2 Defective Product Return: The user must inform VITA MAZHAROVA of the non-conformity of the product within two months of becoming aware of it. If the product is defective from the origin, you must send an email to info@vamzshop.com with the order number and explaining the reason for the return. Our Customer Service department will contact you via email or phone call, informing you how to proceed with sending the defective product and providing you with a return number.
The product(s) from the order must be returned to the address we will provide, with all the items it was delivered with, in perfect condition, without damage or marks indicating improper use of the item or use different from its intended purpose.
Once the defective product is received in compliance with these requirements and it is verified that the product(s) have a manufacturing defect, we will contact you to manage the repair, replacement, price reduction, or termination of the contract. In any of the above cases, the resulting expenses will be borne by VITA MAZHAROVA.
9.3 Return of Non-Defective Product: When the product has no defects whatsoever and its return is due to lack of knowledge or misuse, VITA MAZHAROVA will contact you to indicate the steps to follow for product retrieval.
Shipping costs resulting from the return of a product that has no damage or defect whatsoever will be borne by the customer, and VITA MAZHAROVA will not proceed with said shipment until advance payment of the transportation costs has been received. Verification by VITA MAZHAROVA that the returned product shows damage due to misuse or inadequate protection during shipping may result in the cancellation of the warranty or a reduction in the product's value.
9.4 Return for error in the order by VITA MAZHAROVA: When the product does not correspond to the one ordered, due to an error attributable to the company, the user must notify the company by email as soon as possible; VITA MAZHAROVA will cover the costs of collecting the product sent in error and delivering the one corresponding to the order placed.
9.5 Returns Verification: The verification and checking of products subject to return shall be carried out by VITA MAZHAROVA. Once at her facilities, she will verify that they have been received in compliance with all the requirements established in section 9.1. Failure to comply with these requirements may result in the cancellation of the Warranty or a decrease in the product's value.
In case any of the items are missing, the product will be returned to your home with a note indicating the missing contents.
9.6 The right of withdrawal shall not apply in the following cases:

- REFUNDS
10.1 Refund of Shipping Costs: If you request a refund of the shipping costs for the return, you must send the products via standard mail (regular letter). Responsibility for the shipment lies solely with the shipping company or carrier contracted for that shipment. Any additional costs incurred from using expedited delivery services will be the customer’s responsibility.
10.2 Refund for Return: In case of return, the refund of amounts paid will be made through the payment method used for the purchase. VITA MAZHAROVA will not refund the amount or make any reshipment of merchandise until the receipt and condition of the packaging and accessories of the product subject to return or exchange have been verified at our warehouse.
10.3 Refund Period: The refund will be processed within 15 business days of receipt and verification of the conditions of the shipment's receipt. The maximum period for making the established payment is one month. To proceed with the reimbursement, you must provide us with the following information:

- APPLICABLE WARRANTIES AND AFTER-SALES SERVICES
11.1 Warranty: All products offered through the website are completely authentic, unless otherwise stated in their description.
All products come with a 2-year warranty period, in accordance with the criteria and conditions described in Law 3/2014, of March 27, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, except in exceptional cases where it may be of a different duration.
In the event that the Consumer Goods Sales Guarantee Law (23/2003, of July 10) establishes that the product must be sent to the manufacturer to manage said warranty, the VITA MAZHAROVA team will inform you how to proceed via email or phone call. In these cases, VITA MAZHAROVA is not responsible for how the manufacturer processes the warranty for said product.
- APPLICABLE WARRANTIES AND AFTER-SALES SERVICES

- Unless proved otherwise, products shall be deemed to conform to the contract provided that they meet all of the following requirements, unless any of them are not applicable due to the circumstances of the case:
(a) Match the description provided by VITA MAZHAROVA.
(b) Are suitable for the uses for which products of the same type are ordinarily intended.
(c) Are suitable for any special use required by the customer, provided that the customer has informed VITA MAZHAROVA of such use at the time the contract is entered into and VITA MAZHAROVA has acknowledged that the product is suitable for such use.
(d) Possess the quality and performance that a customer could reasonably expect from a product of the same type, given the nature of the product and, where applicable, the descriptions of the specific characteristics of the products provided by VITA MAZHAROVA.
e) VITA MAZHAROVA provides descriptions, technical specifications, and photographs of the products as supplied by the manufacturer; therefore, it is not bound by these public statements.
- Unless proved otherwise, products shall be deemed to conform to the contract provided that they meet all of the following requirements, unless any of them are not applicable due to the circumstances of the case:

- Non-conformity resulting from incorrect product installation shall be equated to non-conformity of the product when installation is included in the sales contract and has been carried out by VITA MAZHAROVA or under her responsibility, or by the USER when the defective installation is due to an error in the installation instructions.

- Liability for non-conformities that the User knows or could not have been unaware of at the time of the conclusion of the contract or that originate from materials supplied by the User shall not apply.
11.2 Defective Products: In the event of a defective product, VITA MAZHAROVA shall proceed with repair, replacement, price reduction, or contract termination (as appropriate), actions which shall be free of charge for the user. VITA MAZHAROVA is liable for any lack of conformity that becomes apparent within a period of two years from delivery, provided the user informs VITA MAZHAROVA of the lack of conformity within two months of becoming aware of it.
11.3 Warranty Voiding Conditions: The warranty does not apply under the following conditions:
- Liability for non-conformities that the User knows or could not have been unaware of at the time of the conclusion of the contract or that originate from materials supplied by the User shall not apply.

- Deterioration caused by adaptations, adjustments, or modifications made to a product without written agreement from the manufacturer.,

- Expenses related to maintenance, repair, or replacement of parts due to normal wear and tear,

- Breakdowns and deterioration of accessories,

- Deterioration caused by misuse of the product, improper use, failure to follow instructions for use regarding its operation and maintenance, or improper installation.,

- Damage caused by unauthorized persons or the user,
-
- Damage caused by accidents, lightning, floods, fires, or any other cause not attributable to the manufacturer,

- Damage caused by a system failure in which the product may be incorporated,
-
- If the product model or serial number shows any modifications,

- Use of the product outside the family and private sphere, for example in intensive professional use, or
-
- Products previously repaired by repair services other than VITA MAZHAROVA.
11.4 Replacement of an irreparable product: If the product is deemed irreparable or the cost of repair is disproportionate to its value, it will be replaced with an identical one. If the latter is not possible, we will offer you a product with identical or superior characteristics.
Replacing your product will conclude your purchase agreement and any warranty extensions, as acquiring a new product will result in a new contract due to it being a new purchase.

In accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free online dispute resolution platform for disputes between the USER and the PROVIDER, without the need to go to court, through the intervention of a third party, called a dispute resolution entity, which acts as an intermediary between both. This entity is neutral and will communicate with both parties to reach an agreement, and may ultimately suggest and/or impose a solution to the dispute. If any clause included in these General Terms and Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall only affect said provision or the part thereof that is null or ineffective, with the General Terms and Conditions remaining in full force and effect in all other respects, and such provision, or the part thereof that is affected, shall be considered as not having been included.

These terms and conditions shall be governed by and construed in accordance with Spanish law in matters not expressly provided for. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these terms and conditions to the Courts and Tribunals of the provider's domicile (if a legal entity) or the user's domicile (if a natural person).
In the event that the user is domiciled outside of Spain, the provider and the user expressly waive any other jurisdiction, submitting to the Courts and Tribunals of the city of Barcelona (Spain).
